VOX has sued against the electoral representative of that party in the province of Santa Cruz de Tenerife, Débora Rodríguezfor the alleged crimes of unfair administrationcontemplated in article 252 CP; electoral crime, Article 139.1 of the Organic Law of the General Electoral Regime (LOREG); and crime for preventing the exercise of civic rights recognized by the Constitution and the laws of article 542 of the Penal Code, announced this Tuesday the ultra-right formation.
The party goes to court after its electoral representative in Tenerife, -who had accepted the position of guaranteeing compliance with the obligations imposed by LOREG on political parties. such as those of protecting and guaranteeing the rights of the formation that represents and the candidacy-, “hid that four candidates they had renounced going on lists, by notarial deed“. In fact, according to VOX, “It was not communicated to the Electoral Board until half an hour before the end of the legal term. That is why the formation that Rodríguez represented did not have time to react.”
Although VOX sent the necessary arguments to the Electoral Board, as well as an alternative candidacy, which was not accepted, and the Prosecutor’s Office has recognized that Rodríguez overstepped his duties and “with fraud violated VOX’s right to participate, the TC decided, once again, to ignore the matter; in a new destruction of Justice,” they denounce.
Specifically, Rodríguez’s action has caused harm to a candidate and to the formation, which takes the form of not being able to attend the electoral process, violating the fundamental rights of both, and the right to political participation. And it is that “without the participation of the electoral representative, it would not have been possible to achieve the objective: boycott the VOX candidacy.”
“He took advantage of the trust placed”
The National Legal Vice-secretary of training, which directs Martha Castro, understands that the electoral representative of VOX in Tenerife “exceeded her duties” to the point of “taking advantage of the trust placed, with fraud, intent to harm, and with serious disloyalty to the person who appointed her to represent heras he did, breaching his most essential obligations towards the party and candidate he represented”.
In fact, when the formation is “informally” informed of the non-proclamation of the VOX list in the province of Santa Cruz de Tenerife, VOX tried to contact Rodríguez, whom they were unable to locate, as is proven in the complaint.
For this reason, the formation requests that a statement be taken from the defendant, and requests the offer of shares as injured party to Alejandro Santiago Gómez Rodríguez, number one candidate for the Congress of Deputies in the candidacy presented by the political formation and statement as a witness.
The Legal Vice-Secretary also requests that a statement be taken, also as witnesses, from those who were part of the candidacy, which has not finally been proclaimed: Manuel Ángel Molina Cordón; Salvador Miguel Lucena Segura; Encarnación Viso Ollero; Monica Paris Silva; Iván Bienvenido González Ríos.
VOX encourages all the voters of Santa Cruz de Tenerife to vote for the VOX candidates on the Senate ballot to be part of a real change of course that puts an end to sanchismo and recover the policies that defend what really matters: “the freedom, security, borders, our countryside and industry”.
