Two years in prison for a woman who struck a man with an iron bar in Tenerife

The Provincial Court of Santa Cruz de Tenerife has reduced the sentence for injuries to a woman from three and a half years to two.

This is for an incident in October 2022, when she assaulted a man with a one-metre-long iron bar.

The events began on 14 October of that year, when the woman started to insult the complainant “without reason” repeatedly while they were in a bar in El Ravelo, in El Sauzal, where they both lived.

The man felt intimidated, so he did not leave the premises until he was sure he could not see the accused nearby, at which point he went home. However, on his way, he passed by the home of the accused, who emerged carrying an iron bar.

With the intent to cause harm, she began to strike the victim on the head, inflicting a wound that required stitches, pain relief treatment, and analgesic control for a week, leaving him with a two-centimetre scar.

During the trial, it was never demonstrated that the woman had impaired mental capabilities or that she acted under the influence of drugs or a possible withdrawal syndrome.

As a result, the sentence was set at three years and a day in prison and a payment of €1,080 for the damages caused.

The accused had previously been convicted of two offences of domestic violence, but as the duration of the sentences and the date of expiration were not specified—only that they were not subject to cancellation—the initial sentence was reduced as the aggravating factor of recidivism was not proven.

The testimony of the assaulted man is considered to have been expressed in a “coherent” manner, consistent with what was stated during the investigation, and was “firmly” confirmed by a witness who observed the events.

The convicted woman described the injuries as “minor,” which was rejected by the Court, taking into account that a one-metre iron bar was used, considered to be a dangerous weapon.
