The man accused of sexual assault on a young woman during the music festival celebration in the south of Tenerife admitted today that he is guilty of a crime against sexual freedom and that although they kissed, at one point the victim asked him not to continue.
“My mistake was not letting her go when I pulled down my pants and she asked me to stop, which I regret very much and I apologize for,” the accused said today during the last session of this trial being held in the Provincial Court of Santa Cruz de Tenerife.
The events took place in the summer of 2019 when the man allegedly locked the victim in a portable bathroom, subjected her to touching her and after lowering his pants, he masturbated while the young woman made it clear that she did not want to continue.
However, the accused said that he was so excited that he asked her to wait until he ejaculated, but denied that he had acted violently against her by grabbing her by the neck or preventing her from leaving.
The expert reports have not found traces of semen on the girl’s clothes and there are no significant wounds, other than scratches.

The Prosecutor’s Office reduced his request for sentences from 8 to 4 and a half years, considering the mitigating circumstance that he has voluntarily registered the 12,000 euros of civil liability in the Court, but requests that the restraining order be maintained and that a fine be imposed. of 200 euros.

The defendant denied that he knew the girl before, said that they were introduced at the festival and began to dance and talk in such a way that from the beginning “there was a good affinity, we were hesitating and we kissed several times”, not just once as the complainant.
At one point they were going to go together with two other people to the bathroom, but the others got lost and were left alone, he relieved himself in an outside urinal and she entered the portable. Next, he waited for her outside and when she opened it, he entered her without pushing her, they began to kiss her and he touched her a few times “to stimulate her.”
He assures that he did not insert his finger into the young woman’s vagina or mouth and there was no resistance beyond verbally asking her to stop.

The psychological consequences for the victim have intensified
Regarding the expert reports, it was confirmed that no traces of semen or DNA of the defendant were found on the clothes that the young woman provided a month later, a period that is not important when it comes to identifying the evidence to which it is attached. which according to the police all protocols were complied with.
The psychologists indicated that the victim’s story is “coherent, true and although it has some gaps” it is compatible with having suffered a traumatic episode and it is also normal that she would have first confessed what happened to a friend and then to her mother.
Another specialist stated that the young woman had no history of anxiety, but that from this event a set of feelings such as guilt, sleep disorders and also suicidal ideas have been identified that had occurred when she was 16 years old, but that are now resolved. have intensified.
