He Santa Cruz City Councilthrough the areas of Municipal Heritage and Urban Planning, headed by Javier Rivero and Zaida González, respectively, have begun the first inspections of the terraces of tables and chairs, with the objective of ensuring compliance with the requirements established in the law and municipal ordinances, with special emphasis on Universal Accessibility. The infractions, sanctions and procedure of the ordinance, are classified as very serious, serious and minor, and contemplate fines of 1,501 euros up to 3,000 euros; 750 euros up to 1,500 euros, and 60 euros up to 600 euros, respectively.

The mayor of the capital, José Manuel Bermúdez, stated that “it is an essential objective to combine support for the local economy, but without neglecting a city that should be for all people, regardless of their abilities.”

For his part, councilor Javier Rivero reported that “this action has been established after verification by the municipal inspectors of the Heritage and Occupation of Public Space Service, the complaints filed by the Local Police, Municipal Planning Management and neighbors, where some terraces installed on municipal public land do not meet the requirements” and added that “therefore, inadequate locations or installations must be corrected so that the sidewalks are accessible and allow the transit of people with some type of disability or problems.” of mobility.”

The councilor of the Municipal Urban Planning Management (GMU), Zaida González, stressed that “various situations of non-compliance have been detected, such as premises with permission to carry out the activity, but without a terrace license, as well as premises with a terrace permit, but that exceeds the authorization granted.” She pointed out that “the purpose is not punitive in nature but rather the intention is for the business owners to regularize or comply with the granted license.”

On the other hand, the City Council has reported that the period of action will be the last quarter of 2023, from October to December, and in this sense compliance with the Urban Landscape ordinance of Santa Cruz de Tenerife will be taken into account, which details the cases of non-compliance regulated therein, which classifies, first of all, the risk to the safety of people or property, a case in which immediate actions will be taken by municipal services, without prior administrative resolution.

Another case is that in which the installation of the terrace does not have a qualifying title from the GMU, with disciplinary procedures, lack of payment of taxes, a situation in which the ordinance contemplates revocation by reasoned resolution and without the right to compensation, case in which that the facilities must be removed within 7 days, upon request, or subsidiary execution.
