Neighbor Assault in Tenerife Leads to 3.5-Year Jail Sentence and €8,000 Fine

A man charged with a crime of bodily harm is set to face sentencing next week by the prosecution in Santa Cruz de Tenerife, which is demanding a prison term of three and a half years alongside a payment of 8,000 euros for civil liability and medical costs following an assault on a neighbour.

The Public Ministry has reported that the accused confronted a neighbour, with whom he had a strained relationship, and asked him to sit down for a discussion to resolve their differences. The neighbour declined the invitation and returned to his flat.

Remaining outside the building, the accused began shouting from the car park half an hour later, demanding the neighbour come down to fight. In response, the neighbour explained that he had taken medication prescribed by his psychiatrist and intended to sleep.

Despite his refusal, the pressure from the accused compelled the neighbour to descend to the entrance hall, where he found himself on the final steps near the mailbox.

The attacker then forcefully pushed him against the wall, leaving him disoriented. Subsequently, the aggressor fell to the ground, colliding with the edge of the staircase.

In that moment, the victim endured further blows which rendered him unconscious, resulting in severe injuries including several chipped teeth and wounds on his face, after which the assailant fled the scene.

Shortly after regaining consciousness, the victim managed to call 112. An ambulance arrived at the scene, providing initial medical assistance before transferring him to the University Hospital.

Police officers also arrived to provide assistance and initiated preliminary investigations, ultimately locating the assailant, who was found with blood on his hands.

The Prosecutor’s Office states that the aggressor admitted to the assault, following which the officers proceeded with the arrest.

As a result of the attack, the victim sustained facial trauma, the loss of four teeth, and damage to another, for which he required treatment lasting eleven days, and he continues to suffer from the aftereffects, including scars.

The defendant chose not to testify before the judge and remained in pretrial detention for a period. Upon his release, he was subjected to a precautionary measure prohibiting him from approaching the complainant’s residence within a distance of less than 200 metres.
