The mayor and three councilors of Güímar will have to return their salaries

The judgment judicial that annulssince 2021, the remuneration and exclusive dedication regime of the mayor of Güímar, Gustavo Pérez (DC); the first deputy mayor, Airam Puerta (PSOE), and councilors Juan Delgado (DC) and Candido Gomez (PSOE) for lacking legal protection. For this reason, the municipal group of the PP, the complainant in this dispute, has forced the holding of an extraordinary plenary session on this matter this afternoon.

The popular spokesperson, Carmen Luisa Castro, announces that the PP will defend “in the plenary hall and where it is most needed” the return of the money illegally collected plus interest by the four councilors from 2021.

Likewise, it also urges the four affected by the ruling to abstain from voting in this plenary session because they have in this matter “a real personal interest above the institutional one”, as established by current legislation for these cases.

The ruling that declared the salaries null and void was issued in 2022 by the Administrative Litigation Court No. 2 of Santa Cruz de Tenerife and affects Airam Puerta (since 06/24/2021 (Gustavo Pérez (since 07/1/2021), Cándido Gómez (since 07/12/2021) and Juan Delgado (since 07/12/2021). City Hall filed an appeal, which was not admitted for processing by the Second Section of the Contentious-Administrative Chamber of the Superior Court of Justice of the Canary Islands (TSJC), a decision that, since it was not appealed, has meant that the sentence becomes and firmness. The facts prosecuted date back to 2021, when the alternation in the Mayor’s Office took place (CC gave the position of mayor to the PSOE) and a new and mandatory agreement on partial and exclusive dedication and remuneration was not approved in a plenary session, so the remunerations Since then they have been delegitimized.

In this regard, the leader of the PP makes it clear that “neither the four councilors nor the municipal secretary can claim that I did not warn them from the first moment that an illegality was being committed, but they never fully carried out the agreement that would cover those salaries.” . Hence, the PP spokesperson suspects that this sentence, and not the “surreal excuses given”, is the real reason why the new Government group (CC-PSOE-Unidas Sí Podemos) has applied an “immoral” increase in salary of 27% in this term.
