A resident of La Orotava, in Tenerifewill sit next week on the bench accused of a continuing crime of sexual assault about one of his daughters, a minor, whom he threatened to hit her mother if she refused.
The judgment will be held next week in the sixth section of the Audiencia de Santa Cruz de Tenerife and the defendant faces a possible sentence of 9 years in prison, a restraining order for 5 years and compensation to the victim of 40,000 euros for the damages and the physical, emotional and psychological consequences caused.
As stated in the Prosecutor’s qualification letter, the accused frequently touched his daughter at the family home in La Orotava, taking advantage of the times when the girl’s mother was absent and on one occasion when the family was visiting the house of the minor’s maternal grandmother, in Colombia.
In order for the minor to agree, the document indicates, the defendant told her that if she did not do so, her mother would pay for it and also beat the girl when she refused to perform any sexual practice.
The minor agreed, fearful of what the defendant might do to her or her mother if she did not do so, since, “in effect”, he beat her mother and was convicted of it in a final judgment issued by a Criminal Court of Santa Cruz de Tenerife.
As a result of these episodes, the defendant and the mother of the minor separated and thus the sexual assaults about the girl, who has psychological consequences as a result of these events and the gender-based violence witnessed in her childhood, and who require a psychological intervention program.
