The Municipality of El Rosario has won the administrative dispute opened by the former concessionaires of the cafeteria of the Agricultural Market, located in La Esperanza, against the imposition of two sanctions by the Consistory of Rosario for breaches committed during the operation of the premises. It should be remembered that in the framework of this litigation, at the beginning of last year, very serious and totally false accusations were made about the mayor and the first deputy mayor and in which the reasons for imposing the sanctions were misrepresented with the complicity of various members of municipal opposition groups. The sentence, which is signed by the head of the Contentious Administrative Court No. 1 of Santa Cruz de Tenerife, dismisses the appeal, proves the sanctioned facts and imposes the procedural costs on the appellants.
The court ruling, whose resolution is final and to which no appeal can be lodged, proves that the former concessionaires of the Mercadillo cafeteria failed to comply with the operating conditions signed in the concession document and contained in the administrative and prescription clauses contract techniques. For this reason, the breaches, which are classified as very serious offenses, carried, according to law, a fine of 1,200 euros for each of them as well as the reduction of a quarter of the concession period, “hence there has been no violated the principle of proportionality as the sanction imposed was appropriate to the seriousness of the conduct and adjusted to the Governing Document of the concession contract”, establishes the sentence.
The mayor of El Rosario, Escolástico Gil, expresses “my absolute respect for the litigation opened by the former concessionaires to try to defend their interests, but what cannot be tolerated is that, using this lawsuit as a pretext, members of the opposition groups participated in the theory of confusion and dedicated themselves to supporting acts that only served to propagate baseless hoaxes. They have done them a disservice”, concludes the councillor.
