Los Silos Town Hall has filed an administrative appeal against the Ministry for Ecological Transition and Demographic Challenge to revive the legal opportunity to reclaim the municipal pool facilities. The Council is challenging the resolution dated 23rd January 2022 in which the Coastal and Maritime Directorate denied the request for a new concession for the occupation of the space where the facility is located in order to legalize it.
The local government also requested a precautionary measure authorizing the provisional use of the pool until the proceedings are resolved. “This measure is of vital importance,” they stated in a press release.
The aim of the government team (PSOE-USP) is to exhaust all political, technical, and legal avenues available to the institution to recover the facilities.
On 23rd January 2022, the central Government denied the request for a new concession. The Town Hall had a two-month deadline to file the corresponding appeal. “The previous government team (CC-PP) let the deadlines expire without filing the appeal. Furthermore, no further steps have been taken in this regard since March 2022,” explained the governing group, who claim to have been working since the beginning of their term “to regain the possibility of filing an appeal and reviving the legal opportunity to rescue the facility.”
Municipal authorities state that “this possibility arises from the jurisprudence contribution made by the legal team hired specifically by the Town Hall for this purpose, which allows for exhausting avenues for the appeal to be accepted.” Additionally, from an institutional perspective, they have held inter-administrative meetings to seek solutions and open up possibilities, they clarify.
Simultaneously, the local government claims to have been working on processing a new concession. “Its essence is linked to making a substantial modification of the facilities to better integrate them into the landscape and be more respectful of the environment.” Furthermore, an engineering study is preparing a basic project and report to be submitted with the new concession request to be presented to the General Directorate of Coasts of the Government of the Canary Islands.
Mayor Carmen Luz Baso acknowledges that “the path is complex” to achieve the goal, but she trusts “that justice will be done for the people of Los Silos and that we will be authorized to reopen the municipal pool,” expressing hope.
