The recent ruling by the National Court has denied Aena’s request for the temporary use of the connection to the solar energy plant through Red Eléctrica de España (REE) at Tenerife South airport.
The court’s decision stemmed from AENA’s appeal following the withdrawal of the access permit by REE, citing the expiration of the permit due to the lack of proof of obtaining the required Environmental Impact Declaration.
In a back-and-forth that began on November 30th, 2023, with the National Markets and Competition Commission siding with REE, AENA turned to legal channels seeking the annulment of the access prohibition to the plant until a final verdict is reached. Consequently, the electricity manager was instructed to halt all activities related to supplying the airport. The Court determined that granting the precautionary measure would result in irreversible damage, underscoring the need for a valid environmental permit even on a temporary basis.
