In 2014, in black spine, there were only a few buildings that have nothing to do with the population that this illegal city has become today next to El Fraile, which is located on rustic land under agricultural protection. Land on which, by definition, there is no room for the provision of residential supply services, since these are only oriented towards urban or developable areas.
That is to say, that in a piece of land with these characteristics, the current supply of water for human consumption that the neighbors receive cannot be given nor, therefore, authorize the corresponding couplings for the reception of the same. In the same way, the energy service cannot be provided.
However, among the information and data of this case, the Prosecutor’s Office must investigate the concession of at least a dozen water couplings or, what is the same, authorization for the connection to the drinking water of the municipality of Arona that could, presumably, have been granted before 2015, according to the data to which DIARIO DE AVISOS has had access and which are part of the exchange of information maintained by the Arona Town Hall and the Canarian Agency for the Protection of the Natural Environment, which has ended up in the hands of the Prosecutor’s Office.
Subsequently, and in parallel, both the former island councilor María José Belda and the former councilor in Arona Antonella Aliotti brought a similar situation before the Prosecutor’s Office in May of this year: the alleged supply of reclaimed water from the public company Balsas de Tenerife (Balten), dependent on the Cabildo de Tenerife, to these houses.
At that time, however, the alleged authorization of water connections to the municipal drinking water supply of a dozen of these properties was not known, an issue that should be investigated in the coming months.
In both cases, the truth is that the granting of this service to fixed or removable dwellings on rustic agricultural protection land is totally prohibited and contributes to the consolidation of an illegal situation, since on this type of land it is not possible to raise any construction or structure oriented to residential use, not only because it goes against land use planning but also because of the environmental damage it can cause.
Although drinking water is a basic service, it cannot be provided regardless of the location of the land, since it is typical of urban centers and can only be provided on plots that have the condition of solar, something that cannot happen in a farm or house located on rustic land.
In fact, the illegal city of Lomo Negro has been growing under an illegal subdivision in which buyers apparently acquire a piece of land on which, for example, to place a home.
However, from a notarial and registry point of view, what they are doing is acquiring the corresponding percentage within a farm of up to 10,000 square meters, the maximum that the law allows to segregate.
As this newspaper has published, the illegal city of Lomo Negro has been growing since before 2014 in the shadow of El Fraile, in the municipality of Arona, on rustic land under land protection.
If in 2015 constructions were hardly visible in it, in 2022 this space was already plagued with them, with more than a hundred homes, which led the City Council to hold meetings with representatives of the Canarian Agency for the Protection of the Natural Environment and Forces and State Security Corps.
From the exchange of information, Leopoldo Díaz Oda being a councilor for Town Planning, and José Julián Mena, mayor, there was first an intervention by Seprona (Civil Guard unit), in which they fenced off and imposed seals that, in addition , were allegedly raised illegally and, subsequently, the Acpmn brought the facts to the attention of the Prosecutor’s Office, which is investigating this matter.
“Closer to your home”: plots still for sale on the internet
“One step closer to home”. This sentence is revealing of what is hidden behind the subdivision of Lomo Negro. Neither the open files nor the action of the Prosecutor’s Office have stopped the sale of the plots, which are offered on the internet for 29,000 euros.
