The Elite Taxi Barcelona association, the official holder of the Elite Taxi brand, has called for the “immediate cessation” of the unauthorised use of its brand by the Elite Taxi Málaga and Elite Taxi Tenerife associations. As noted yesterday by the president of the former entity, Tito Álvarez, “this improper use fundamentally infringes upon our industrial property rights, causing confusion, misuse of our reputation, and direct harm to our image.”
In this context, Elite Taxi Barcelona asserts that it will not permit “the registered name to be granted a legitimacy that it does not deserve in order to acquire personal gains, in clear contradiction to the principles of transparency, collective effort, and defence of the sector that have guided this association.”
Consequently, Elite Taxi Málaga and Elite Taxi Tenerife have been instructed to cease “the use of name and branding, as well as any mention of elite taxi in physical, digital, and social media.”
Elite Taxi has granted a maximum of three business days to the parties involved, following receipt of this notice, to eliminate the use of the name. They are also seeking compensation for damages: €144,000 from Elite Taxi Málaga and €86,400 from Elite Taxi Tenerife.
Álvarez stated that “up until now, we had not taken action against the Tenerife group as we had not observed the practices of its president, Miguel Ojeda, which appear to parallel those of the chief at the capital dock. We have experienced similar situations at Seville airport. We do not want our credibility to be exploited for personal gain.”
The founder of the Taxiista collective further mentioned that “the Association of Tenerife has not made any contributions to the National Federation, therefore on May 16, I will travel to the island to convene an assembly. Should there be a change in the board of directors, we will assess whether Elite remains as Elite Taxi there, but Ojeda must step down; that is non-negotiable. If he fails to do so, we will take legal action against him.”
Álvarez added that “both the Boards of Directors of these associations and their members will face collective legal and financial responsibilities arising from this infringement. Elite Taxi Barcelona will not permit its name to be tarnished or its identity to be manipulated for individual interests.”
Meanwhile, Elite Taxi Tenerife chose not to provide any statements on the matter. Its president, Miguel Ojeda, who represents 70% of professionals in Santa Cruz, preferred to remain silent until a resolution is reached.
