The Superior Court of Justice of the Canary Islands (TSJC) has declared the Ordinance of Mobility and Road Safety, which was sanctioned by the City of Santa Cruz in January 2024, to be null and void, asserting that it fails to comply with the law.
In the ruling, TSJC magistrate Manuel Hernández Cordobés evaluated the contentious-administrative appeal lodged by the Neighbourhood Association ‘El Perenquén’, which invalidates the municipal regulations governing matters such as the low emissions zone (ZBE), parking restrictions in green and blue zones, and regulations concerning personal mobility devices like electric scooters.
“The contested ordinance is entirely void; therefore, our judgement has ‘ex tunc’ effects, meaning it must be regarded for all intents and purposes as though it has never existed. It has never held validity, let alone effectiveness, as it was unable to come into legal existence, merely presenting a facade of legality that is now, through this judgement, duly annulled,” states the TSJC.
