The Superior Court of Justice of the Canary Islands (TSJC) has annulled the Mobility and Road Safety Ordinance enacted by the City of Santa Cruz in January 2024, determining that it is not compliant with the law.
In the ruling, the TSJC magistrate Manuel Hernández Cordobés accepted the contentious-administrative appeal submitted by the El Perenquén Neighbourhood Association, which invalidates the municipal regulations regarding matters such as the low emissions zone (ZBE), parking restrictions in green and blue zones, and all regulations pertaining to personal mobility vehicles like electric scooters.
“The ordinance that has been challenged is entirely void; consequently, our judgement has ‘ex tunc’ effects. Therefore, it must be treated as though it had never existed, as it has never been valid, let alone effective, since it was unable to be brought into legal existence. It has merely been an illusion of legality that is now definitively removed by this ruling,” states the TSJC.
