€20,000 Penalty for Breaching Coastal Regulations in Southern Tenerife

The Provincial Coastal Service of Santa Cruz de Tenerife, under the Ministry for the Ecological Transition and the Demographic Challenge, has initiated three disciplinary actions, amounting to a total of 19,820 euros, against two kiosks situated in coastal regions of the municipalities of Arona and Adeje, as well as a surf school from Granadilla de Abona. These actions were reported yesterday in the Official Gazette of the Province of Santa Cruz de Tenerife (BOP).

The most substantial penalty relates to a 20 square metre kiosk with an additional terrace of 50 square metres located in the southern area of Las Vistas Beach in Los Cristianos (municipality of Arona), for which the owner is liable to pay a fine of 14,000 euros.

The second case concerning an infraction of Costa regulations involves a smaller kiosk, measuring only four square metres, which also includes a identical sized terrace on Playa del Bobo in the municipality of Adeje. The owner will face a financial sanction of 4,320 euros.

The third violation pertains to the Surf Center school, affiliated with the Playa Surf hotel in El Médano (Granadilla de Abona), for occupying space in the public maritime-terrestrial domain without proper administrative consent, specifically “by conducting windsurfing and kitesurfing lessons for profit,” as detailed in the notification of the Official Gazette of the Province of Santa Cruz de Tenerife. The penalty imposed by the Coastal Service amounts to 1,500 euros.

PERIOD OF 15 DAYS TO CONSULT

In each of these instances, the official publication highlights that the sanctioning files are accessible to the affected parties for consultation and comprehensive understanding of the matter for a duration of 15 days (counting from the day following the announcement’s publication yesterday) at the Provincial Coastal Service, located at Rambla de Santa Cruz de Tenerife, number 169.

All three notifications were made public yesterday in the BOP following an “unsuccessful attempt,” as the bulletin indicates, to establish individual communication at the last known addresses of those involved, in compliance with articles 44 of Law 39/2015, of October 1 concerning public administrations and common administrative procedures.
