Santa Úrsula City Council terminates the pool contract with Eulen SA

“Once the decision is communicated and regardless of the decision adopted by the concessionaire, the City Council will issue a new tender for the management of the sports complex and municipal swimming pool with favorable conditions and the necessary facilities so that the contest does not remain deserted” . This was assured by the mayor, Juan Acosta, after the municipal plenary session unanimously approved on Tuesday the termination of the contract with the company Eulen SA, which managed the service from 2011, the year the facility was inaugurated, until June 2019 and empowered the mayor to start the liquidation process in order to re-obtain a concession and that the facility can open to the public after two and a half years closed.

This matter had the approval of all the political groups in the Municipal Corporation, who learned the details of the opinion of the Canary Islands Consultative Council issued on July 22, which determined that the contract was terminated due to the resignation of the contractor as of July 30. June 2019 and therefore the seizure of the service by the City Council proceeded without refund of the deposit, as required by the concessionaire.

Likewise, he made it clear that it was not appropriate to compensate the workers because this derived from an early resignation of the contract that is not attributable to the City Council, which has not been able to subrogate a third party in the management of the public service ”.

However, the report makes it clear that except for structural defects such as the foundation or vertical structure of the property, Eulen had to maintain the facilities and that the City Council will have to make an estimated investment of about 400,000 euros to leave the facilities in the same conditions in which they were before formalizing the contract with the concessionaire. It was an external company hired by the City Council that carried out a study evaluating the defects that the pool currently presents.

The truth is that for three days we can talk about a point and a separate in the chapter of the municipal swimming pool of Santa Úrsula, closed two and a half years ago due to the lack of agreement between both parties. At that time, the company argued an economic deficit in the management that made it unviable despite the fact that the contract signed with the City Council ended in 2026.

“It will be necessary to see what formula we adopt and if the necessary works are assumed by the City Council or the company that wins the tender for the service and it is deducted from the canon”, says the mayor, who emphasizes that “the City Council will give all the facilities so that the pool is put into operation and with the due guarantees ”.

Regarding the deadlines, it indicates that it is first necessary to have a market study on the basis of which the tender will be made.
