Notice to vacate for eight families renting in La Perdoma

On the 21st of May, the eviction of eight housing units in the Casablanca Urbanization, in La Perdoma, is scheduled due to rent arrears incurred by the families since 2020. This was indicated by the Court of First Instance and Investigation number 3 in La Orotava. Previously, on the 24th of April, a hearing is planned for the claim for amounts owed by the current property owner, Reigahill Invest SL. The affected families claim they have never refused to pay and have shown willingness to negotiate, but the reporting party has refused.

Although the urbanization located in Camino El Moñigal consists of 16 properties, only the eight that are in a rental arrangement are in this situation. Among these families are individuals at risk of social exclusion, with severe degenerative diseases, and dependent minors.

Two months after Gregorio and Marta rented the property in 2015, a court official informs them that the property is in the process of foreclosure and they must continue making payments to the company they signed the contract with, Roycasa. In July 2020, the same court notifies them to stop payments and that BBVA, the current owner of the property, will contact them. It wasn’t until 2023 that they received a judicial summons for a trial resulting from a bank’s lawsuit for almost 20,000 euros and eviction. The trial did not take place due to a change in ownership.

Affects minors, individuals at risk of social exclusion and with severe degenerative diseases

Previously, in 2022, and following a previous auction that had no bidders, Haya Real State demands 18,500 euros for unpaid monthly fees, and on the 14th of April 2023, Reigahill Invest SL enters the picture, notifying them via burofax that they had to vacate the property by the past 27th of August, and every Friday “a supposed mediator visits us to pressure us.” Three weeks ago, they received the lawsuit resulting in the demand for unpaid rent since 2020 and the indication of the trial and eviction.

Marta Rodríguez’s case is that of a woman with multiple sclerosis who, as a disabled pensioner, and her husband, an unemployed individual receiving the Canarian Citizenship Rent, collectively earn around 1,650 euros per month. The report issued by Social Services on the 12th of June 2023, at judicial request, states that there is “no situation of social vulnerability” here.

The woman claims that the mayor simply referred her to Social Services, where she was advised to change municipalities.

The municipal government states that it will study this case once it has access to the documentation requested from the affected party. They assure that the City Council will consider options that can be implemented and are viable, both at the municipal level and by mediating with regional and island administrations.

Asamblea por La Orotava held a meeting with the families affected “by the pressure from financial entities and investment funds.” This political group expressed its “firm intention to advocate for these families and urge the ruling party, Coalition Canaria, to seek solutions to prevent eviction or offer alternative housing.” In this context, they announce that they will bring this situation to the municipal plenary, “seeking responses and concrete actions from the ruling party.”
