Developer affirms that the La Tejita hotel is not affected by the new boundary

The developer of the La Tejita hotel asserts that the rulings of the Canary Islands High Court of Justice (TSJC) endorse that the new demarcation does not impact the progress of the project. The construction work is continuing as planned since its resumption last February, as all the licenses and authorizations supporting the developer for its execution are currently valid and effective.

Viqueira explains that the report from the General Directorate of the Coast and Sea, dependent on the central government, to which groups opposed to the project refer to “is from 2021 and all its arguments are annulled by subsequent rulings of the TSJC”.

The developer recalls that the TSJC rulings state, literally, that “the urban planning authorization and license, therefore, complied with the demarcation of the current coastal-maritime zone and, as the Supreme Court ruling, Third Chamber, Section 5, of May 6, 2002, states, the demarcation initiated subsequently cannot affect licenses already granted”.

Likewise, the TSJC also points out in one of its rulings that “this is not about carrying out works without the required administrative authorizations, but that due to the new demarcation, the property becomes a concession title as compensatory value, as established by Constitutional Court ruling number 149/1991, of July 4,” as stated by the company.

The developer notes that on February 22, it informed the General Directorate of the Coast and the Sea, through a written document, that the works would be resumed. “Therefore, the start of the works could not have caught anyone by surprise, as claimed,” states the company.

In a statement released yesterday, Viqueira explains that subsequently, on February 26, as stated in said document – which also included the TSJC rulings – the works were resumed. “On the same day, the technicians from the Coastal Provincial Service of Tenerife and from the Canary Islands Government went to the plot and signed the Restart Act of the works,” it affirms.

The developer insists that the TSJC pronouncement “is very clear” and, therefore, it is authorized to carry out the construction works of the La Tejita hotel.

One aspect highlighted by the company is that the project “blends in with the landscape” and that “it constructs many fewer beds than allowed”. Specifically, it mentions that “at the frontline, the permitted height of three floors is almost entirely reduced to one floor”. It also emphasizes that the construction of the tourist complex “will generate around 200 direct jobs and over 300 indirectly”.

The developer, Viqueira Group, acquired the urbanization where the hotel plot is located in 1994. During this time, it has been promoting various actions to create a nucleus where currently more than 1,000 families reside, over thirty small businesses, mostly run by Canary SMEs, and has delivered over 18,000 square meters of green and recreational areas for public use and enjoyment.
