The Court of Santa Cruz de Tenerife will judge next week a man accused of sexually assaulting his partner, who had a restraining order in force, while she was unconscious after hitting her several times.
The Prosecutor’s Office requests penalties totaling 19 years in prison for the crimes of violating a restraining order, injuries and sexual assault, as well as compensation to the victim in the amount of 3,700 euros.
As stated in the qualification document, the defendant was being prosecuted for possible crimes of mistreatment and threats to his partner, for which he was prohibited from approaching her within half a kilometer and could not communicate with her either.
Despite these precautionary measures, both continued to see each other intermittently and in fact, on one of the days that she was at his home in La Laguna, the events occurred.
During an argument, the man severely hit the woman on the head with a 135-centimeter wooden curtain pole, used a kitchen knife and struck several blows all over her body until she fell unconscious to the floor.
From here the defendant dragged her to the bathroom, moments in which the victim was completely unprotected to repel the continuous attacks to which she was subjected, the Prosecutor’s Office details.
After waking up, the woman found that her ex-partner had left but she remained lying in the bedroom, where she had been sexually assaulted while she was unconscious.
The events were reported so that the corresponding protocol was immediately activated from the Canary Islands University Hospital (HUC).
The woman had various injuries to her head, bruises on her hand, back, and right eye, among others. The injuries took a week to heal and she currently has no sequelae.
The analyzes reflected that the woman had had relations with two men, one of whom was her then partner, and the presence of alcohol, cocaine, anxiolytics, analgesics, anti-inflammatories, and local anesthetic was detected in her urine.
As for the accused, consumption of alcohol and narcotic substances was identified, but it was not specified exactly what they were, but rather whether they were enough so that he could not decide if he was doing the right thing.
