The Provincial Prosecutor’s Office of Santa Cruz de Tenerife requests a sentence of 15 years and three months in prison for a man for sexually abusing and attacking his niece-in-law in La Orotava.
The summary, collected by Europa Press, indicates that the accused, with a criminal record for road safety crimes, lived with his partner on the upper floor of a house in which the parents also lived while the victim lived on the ground floor, minor, and his parents and the brother of the accused’s partner.
Although the accused ended up marrying his partner and went to live in another house, he continued to frequent the house and on at least two occasions he was left alone with his niece in the television room and sexually assaulted her.
In addition, he was aware that he was a carrier of the human papillomavirus so that the minor suffered condylomas in the genital area for which he had to receive antiviral and surgical medical treatment for 199 days.
The minor has borderline intellectual functioning (FIL) so her “greater docility, suggestibility and less opposition to the guidelines of an adult,” the Prosecutor’s Office points out, was taken advantage of by the defendant to commit the acts.
The Provincial Court of Santa Cruz de Tenerife has already issued a restraining order for the accused less than 200 meters from the victim.
Thus, the Prosecutor’s Office requests 11 years and nine months in prison for a crime of continuous sexual abuse, another three years and nine months for injuries and another 16 years of supervised release, the prohibition of communicating with the victim within 200 meters and the payment of 38,995 euros as compensation.
The trial will be held next Monday, January 15, at 10:00 a.m., at the Provincial Court of Santa Cruz de Tenerife.
