The Prosecutor’s Office requests 15 years in prison for a man accused of raping a minor, to whom he would have transmitted a venereal disease, and whom he considers the author of a continuous crime of sexual abuse and another of injuries.

The trial will begin next week in the Provincial Court of Santa Cruz de Tenerife and the Prosecutor’s Office also demands that the accused pay 39,000 euros, of which 30,000 correspond to compensation for moral damages and the rest to health expenses that the parents had to face. the victim.

The young woman has a borderline intellectual functioning, so she has greater docility, suggestibility and less opposition to complying with the guidelines of an adult and, ultimately, limited critical judgment, which would have been used by the man to carry out the abuse.

The accused lived on the upper floor of a house located in La Orotava with his romantic partner and in-laws, while on the ground floor the minor was with her father, who was the girlfriend’s brother, making the accused his uncle-in-law. .

The man married and moved to another residence but continued to frequent his in-laws’ residence, so on at least two occasions he took advantage of this circumstance to stay alone with the minor and rape her.

The events took place when the defendant knew that he was a carrier of a sexual disease that he transmitted to the minor, which is why he required her to be treated for 199 days in which he was unable to lead a normal life.

At the time, a precautionary measure of distancing of two hundred meters was imposed, which is now requested to be maintained for ten years, another six years of supervised release, the obligation to participate in a sexual education program and not be able to carry out work that involves relationships with minors for fifteen years.

Given that the events took place before the entry into force of the organic law that regulates sexual assaults in October 2023, the accusation focuses on abuse and in principle the modification could not be applied either because it is not more favorable to the inmate.
