The case against the mayor of El Sauzal is filed after eight years

The Court of Instruction number 4 of San Cristóbal de La Laguna has agreed on the archive of the open case against the Local Government Board of the El Sauzal City Council, chaired by Mariano Pérez, on the Authorization of a building permit for the construction of a building on Inmaculada Avenue.

The events date back to June 2007, when the Local Government Board, chaired by Don Mariano Pérez Hernández, granted a construction license for the construction of homes in the municipality of El Sauzal.

In 2010, municipal technicians endorse the decision made by the Local Government Board when considering that the construction was compatible with the uses of the land and had a first occupation license. In the same sense, the Area of ​​Economic Development, Commerce and Employment of the Tenerife Council.

For all this, and according to the order signed by the magistrate-judge of the Court of Instruction number 4 of San Cristóbal de La Laguna, she considers that the perpetration of the reported crime does not appear to be duly justified and proceeds to agree to file the case.

For the mayor of El Sauzal, Don Mariano Pérez, this resolution “ends eight years of suffering for my colleagues on the Local Government Boardour families and our friends.”

Three other cases closed

The City Council of El Sauzal has also received the resolution of file of other open cases, in this case, after the complaints of the councilor of the Socialist Party in the El Sauzal City Council, Don Benigno Guillén Rodríguez, two of them, during the pandemic caused by the coronavirus.

In November 2020, The Prosecutor’s Office received a complaint for administrative prevarication after the granting of exceptional aid to businesses and the self-employed.

In the decree of the Prosecutor’s Office, the actions were archived when it was justified that the actions carried out by the mayor had been in accordance with the law.

In February 2021, a new complaint was filed against the El Sauzal City Council by celebrate the annual walk towards the Servant of God, during the Covid pandemic, understanding that the regulations for outdoor activities were complied with. In this case, the City Council was sentenced to pay a fine of 3,500 euros for a serious violation of health regulations regarding Public Health.

The City Council of El Sauzal proceeded to appeal this decision, and said appeal was upheld by the Contentious Administrative Court No. 3, which revoked the sanction imposed and left it without effect, forcing the money from the fine to be returned to the City Council.

The last of the complaints was filed against the electricity bills repaired by the mayor as there is not enough credit in the budget item. This complaint was also filed considering that the City Council was obliged to assume the extra cost to avoid cuts in the supply of municipal facilities.

Pérez states that “the policy “We must dignify it and not everything goes because our job, as public officials, is to ensure the common good of the Sauzaleros.”
