The Provincial Court of Santa Cruz Tenerife has annulled the restraining order against him man convicted in the first instance of attacking his brother during an altercation that took place on January 11, 2022 in La Laguna, which allows him to return to the building owned by the family at whose doors the events occurred.
For the rest, a sentence of two years in prison is maintained, although in principle he will not go to prison, the payment of compensation of around 2,000 euros and the medical expenses incurred after breaking a tooth after hitting him with his head.
During the trial that took place a few weeks ago, the Santa Cruz de Tenerife Prosecutor’s Office agreed to reduce the request for prison sentences from five to two years by taking into account the expert report in which it was noted that the tooth was already damaged.
The ruling is not final and there is the possibility that it will be the subject of an appeal by the rest of the family who, however, until now had not appeared as a public accusation.
The attacked brother said that that day around eleven in the morning when he was going to enter with the shopping bags into the building where the relatives live in La Laguna, he met the aggressor at the door, who was wearing a worker’s helmet and a sickle-shaped broom stick and that’s when he hit him with his head.
Three days earlier there had been another altercation between them in which the man now convicted in the first instance was injured, and he had already warned that he was going to file the corresponding complaint.
That January 11, the aggressor prevented the attacked person from entering the building, a struggle ensued and the defendant allegedly hit him in the mouth with his head, causing his tooth to fall out.
However, the victim could not relate exactly what the attack was like because he was dazed and everything happened in a very short time. He only remembers that he fell to the ground and picked up the tooth, in addition to denying that there was any prior provocation.
Behind these confrontations lies a dispute over the distribution of the inheritance which includes this building, which the condemned man refuses to distribute among the other brothers who, in addition, report that on several occasions he has tried to evict them.
