SANTA CRUZ DE TENERIFE, June 13 (EUROPA PRESS) –
The Superior Court of Justice of the Canary Islands (TSJC) has temporarily suspended, and for the third time, the catalog of Francoist vestiges approved by the Ministry of Education, Universities, Culture and Sports of the Government of the Canary Islands on November 4, 2022, with which is added to the previous rulings in favor of the Raíces Historical Memory Claims Association and the Santa Cruz de Tenerife City Council itself.
The order of the second section of the Contentious-Administrative Chamber, made public this Tuesday, recognizes the “active legitimacy” of the plaintiffs –Association for the Investigation and Protection of the Historical Heritage of San Miguel Arcángel– given that among its purposes there is the defense of “the truth of historical memory” against the supposed “excesses” of the application of the Historical Memory Law.
The Chamber once again bases its arguments on the lack of publication of the catalog in the Official Gazette of the Canary Islands (BOC) and the lack of a public hearing, although it acknowledges that the Executive already complied with the publication on May 10 –what was previously It was a link to the Ministry’s website.
An appeal for reinstatement has been filed against this order, still pending processing, TSJC sources specify.
