The Court opens preliminary proceedings for the occupation of Cuna del Alma

The Court of Instruction number 3 of Arona opened previous proceedings for the invasion of the land where the Cuna del Alma tourist project is developed, in El Puertito de Adeje. Judge Marco Eulogio Chiang began to take statements from 25 defendants, alleged occupants, as well as from the Compensation Board, the project director and the three complainants. The appearances will continue until the next day 29.

ANDhe procedure 2212/2022 is the result of the judicial decision to unify the multiple complaints filed by the company Segunda Casa Adeje, SL since on July 22 of last year a group of activists camped for the first time in the area where the works were taking place. In such complaints, issues such as trespassing, assaults, occupation, disobedience, damage to machinery and damage to works are allegedly alleged.

The moment of greatest tension was recorded on September 26, when a group of activists appeared at the company’s offices, where two of the protesters entered and where there was an altercation with the project director. This situation also generated two lawsuits against the manager by the occupants, who had previously denounced an alleged violent eviction attempt by the company.

On December 2, the General Directorate of Cultural Heritage of the Government of the Canary Islands totally suspended the works of the Cuna del Alma project, whose first stone was laid on May 5. On the 30th of the same month, there was a partial stoppage of the works ordered by the Cabildo de Tenerife after the denunciation of the Tegüico collective arguing the destruction of archaeological remains. The High Inspectorate of the General Directorate of Cultural Heritage proposed a sanction of 600,000 euros to the company, while the Ministry of Ecological Transition paralyzed the work in a precautionary manner due to the presence of the plant sad viper. Last November, the Canarian Agency for the Protection of the Natural Environment announced another penalty of 110,000 euros because the project lacked an environmental impact report. The total stoppage of the works took place more than seven months ago on the basis that it affects engravings and archaeological remains.

The company has defended at all times that it has the mandatory authorizations to develop this project.
