The Provincial Court of Santa Cruz de Tenerife hosts this Tuesday, at 10:00, a judgment against a man accused of convince to one minor to send him intimate photos through his mobile phone in exchange for small amounts of money and trinkets.
The Prosecutor’s brief, collected by Europa Press, indicates that the events occurred between the months of March and June 2020 when the man, who had transferred a rental home to the parents of the minor, contacted her through the WhatsApp application and convinced her, without mentioning violence or intimidation, to send the images. At least it is clear that he sent her up to five images of her genitals, her breasts and her ass.
In addition, he repeatedly invited her to go up to his house and propositioned her about acts of a sexual nature without it being proven that there was touching or that he even exposed himself naked to the minor.
The Prosecutor’s Office considers that the man took advantage of the minor’s young age and lack of maturity to commit the acts and that the minor agreed for fear that he would show his parents the conversations they had had through social networks.
The minor did not suffer objectifiable consequences derived from the facts and the accused had his freedom limited by being prohibited, by court order, from approaching less than 300 meters from her.
The Santa Cruz de Tenerife Prosecutor’s Office requests a sentence of five years in prison for a continued crime of sexual provocation, the prohibition of approaching less than 500 meters from the victim for 12 years and the prohibition of communicating against her for another 11 years .
Alternatively, the Prosecutor’s Office requests two and a half years in jail for a continued crime of sexual abuse of minors (child grooming). At a general level, it also requests a sentence of probation for ten years and the payment of compensation of 3,000 euros to the minor as compensation.
