The Civil Guard gave a fraudulent award to a ‘Mon’ company

The Lanzarote contractor Angel Ramon Tejera de Leonbetter known as Mon, through his company Angrasurcor, managed to get the General Directorate of the Civil Guard, in a direct order, to award him the demolition works of the old Garachico barracks (Tenerife) despite the fact that the company was not specialized in that kind of jobsnor did he own adequate machinery to carry out an intervention of these characteristics.

The demolition of a property does not appear as an activity of Angrasurcor in its corporate purpose or in the relevant records of the Social Security or the Tax Agency. In that operation, Tejera de León made more than 106,000 euros of profit, despite the fact that, in reality, all he did was mediate, since the work was carried out by a subcontractor.

The house-barracks of the Villa and Puerto de Garachico suffered a serious problem of aluminosis and had to be evicted, to later demolish it. From the General Directorate of the Civil Guard it was considered that there was no other possible solution for the property.

So, In January 2017, a report was drafted arguing the need to undertake the demolition. It was prepared by the colonel in charge of the Civil Guard Quartering Service, with the approval of the lieutenant general deputy general director of Support, Pedro Vázquez Jarava, the high command investigated in the corruption plot in the reforms of quarterings and commands of the armed institute in thirteen provinces.

To award the project, the emergency procedure was used, which is contemplated in the Public Sector Contracts Law. The Civil Guard requested a budget from two companies: Insulares de Demolitions y Obras and Angrasurcor. The intervention awarded the work to the Mon society at the proposal of Lieutenant General Pedro Vázquez Jarava. The concession was made for 168,523.93, through a resolution of the General Director of the Civil Guard on February 14, 2017.

The investigation of the Internal Affairs Service (SAI) of the Civil Guard confirms that the contracting of the Tejera de León company was made despite the fact that the demolition of real estate was not included among the declared business activities. The corporate purpose of Angrasurcor was carrying out reforms and waterproofing, but not demolition and demolition.

Nor was it registered with the Tax Agency under heading 502.1 of the Economic Activities Tax, which refers to demolitions and demolitions in general. And it is not included in the General Treasury of Social Security with code 4311 (demolitions) of the National Classification of Economic Activities (CNAE).

In the vast majority of cases, The main awardees of public works, by the emergency procedure or by others, are commercial companies that have economic and technical-professional solvencyIn other words, they can demonstrate that they have a sufficient level of financial capacity, as well as material means and human resources. It is frequent that, later, these companies subcontract with other local mercantile with less capacity, that execute the intervention.

Once the project was awarded to Angrasurcor at the proposal of Lieutenant General Vázquez Jarava, Ángel Ramón Tejera subcontracted with the Nino business group, from the municipality of Güímar, one of whose companies demolished the Garachico barracks, while the other took care of carrying debris to an authorized landfill.

Both companies of the Nino business group invoiced a total of 62,000 euros, including taxess, according to the report of Internal Affairs of the Civil Guard. In other words, Mon’s company entered profits of 106,523.93 euros. The demolition work carried out with a backhoe loader at the barracks house was estimated by the Nino business group at 25,000 euros, while the cleaning of rubble from the site and its transfer was valued at 37,000.

However, the amounts invoiced by Angrasurcor to the General Directorate of the Civil Guard, with taxes included, amounted to 168,523.93 euros. That total amount was claimed from the Armed Institute through four certifications. The first invoice is dated March 25, 2017 (one month before the demolition began) for 11,023.42 euros; the second was made on April 30 for 12,617.27 euros; the third certification amounted to 62,879.01 and is dated May 31, and the last one, dated July 19, was made for 82,004.23 euros.

The demolition of the security body building began on April 24, 2017. Four days later, the Council of Ministers approved allocating a budget of almost 220,000 euros for said action. In these cases, the allocation is higher than the award budget, since it includes possible cost increases during the process. And it is also normal that in an emergency procedure the works begin first and then the budget is approved by, in this case, the State Government.

In a statement before the civil guards as investigated in May 2019, Ángel Ramón Tejera de León assured that worked through three commercial companies called Angrasurcor and Canarycork, both domiciled in the Canary Islands, as well as Solocorcho, with “fiscal domicile in Madridhaving only the tax domicile for these purposes, without materials or technical means of work typical of business dedication being found in them.

The agents analyzed the headquarters of these companies and a fourth, also owned by Mon, Impermecork. They did not find any work center that could be related to such merchants or any business activity center. And, as is logical, they did not find adequate machinery to face the demolition of a building.

Ten years since aluminosis was detected

Aluminosis in the Garachico barracks began to be detected in 2007. In the summer of 2015, the nearly 30 people who lived in the houses on the compound were evicted due to the obvious risk of collapse of the infrastructure., as the cracks and other damage were already well advanced. For several more months, the work units continued to be used by agents of the Traffic Group of the Civil Guard. However, in April 2016, the property was completely vacated and closed. The activity of the Armed Institute in the town was transferred to the Casa del Pescador, owned by the Government of the Canary Islands and the Garachiquense town hall. From that moment on, The concern of the authorities was that one day it would collapse and affect pedestrians. For this reason, the City Council called on the Ministry of the Interior to adopt some measure. And that is how, almost a year later, the demolition was awarded to Ángel Ramón Tejera de León, better known as Mon, who is quoted in the investigation of the Mediator Case and the Cuarteles Case. At present, in this Garachico plot there is a lot that is used by civil guards and residents of the area to park vehicles. | PF/Raúl Sánchez
