The hearing was scheduled to take place at the Sixth Section of the Provincial Court of Santa Cruz de Tenerife. The defendant had no criminal record until the commission of said crime.

the events occurred in March last year in a street near the tram depots, in the near the stop in the neighborhood of El Cardonal. And the individual was arrested for agents of the Plain Service Unit (USP) of the local police La Laguna, who witnessed the happens of drugs a few meters away.

The aforementioned professionals participated in a joint operation with the National Police of the La Laguna Police Station to catch an individual who he was dedicated to breaking cars and taking money, as well as valuables, that were in the vehicles that he forced. That day the surveillance work corresponded to the aforementioned local police officers.

The municipal agents were inside a camouflaged car, from where they monitored a street where different car destructions and robberies had occurred with the aforementioned procedure. At one point, officers observed a male walk past them and walk down the road.

On that journey, he looked from one side to the other of the street insistently, which began to be suspicious for the local plainclothes police officers. And, shortly after, they realized that another individual was going to meet the first one. The USP agents started the car and approached both of them. When they were about four or five meters away, the officials witnessed a happens of drugs The seller handed over the cocaine with his left hand and picked up the money with his right. The buyer is an individual known to the security forcessince presumably he was also engaged in retail drug sales some time ago.

As stated in the prosecutor’s qualification document, the events occurred at 11:50 p.m. on March 25. The person involved sold two cocaine wrappers for a price of 60 euros in a parking area. One of the wrappers had 1.04 grams and the other 93, with a purity of 71.12 percent.

Quickly, the plainclothes officers got out of the car and addressed both men, while identifying themselves as police officers. The buyer threw the drugs on the ground, while the seller was surprised with the money in his hand.

The arrested man was transferred to the cells of the National Police Station on Calle del Agua, where he was instructed in the proceedings and the protocol was initiated to notify the military authorities of what had happened.

Initially, the prosecutor requested for the defendant two years and six months in prison, as well as a fine of 120 euros. As there is no criminal record and there is agreement between the parties, the penalty was two years in prison. The fulfillment of the custodial sentence will be suspended, on the condition that the defendant does not commit other crimes in the coming years.
