Julio Pérez admits that there may not be time to approve it because there are many initiatives pending and Parliament dissolves in April
SANTA CRUZ DE TENERIFE, 19 Jan. (EUROPA PRESS) –
The Government Council of the Canary Islands has agreed this Thursday, at the proposal of the Minister of Public Administrations, Justice and Security, Julio Pérez, to take into consideration the draft Law on General Regulation and Supramunicipal Coordination of the Local Police of the Canary Islands and submit it to the Advisory Council of the Canary Islands, so that it issues, as a matter of urgency, its mandatory opinion, due to the proximity of the end of this legislature and to guarantee the approval of the law, inasmuch as it establishes the framework of relations between the Government of the Canary Islands and the island councils in terms of police security.
The new norm seeks to replace the current Law 6/1997, of July 4, on Coordination of Local Police of the Canary Islands, by a new legal provision that addresses the competence tasks assumed after the approval of the reform of the Statute of Autonomy of the Canary Islands, by Organic Law 1/2018, of November 5.
This reform has reinforced the powers assumed by the Autonomous Community in matters of security, which are detailed in Chapter VIII of Title V of said Statute: the regional powers are projected in the establishment of public safety policies and protection of people and property, the creation, organization and command of a Canarian Police Corps and in the general planning and supra-municipal coordination of the Canarian local police, collects a note from the Executive.
After the reform, the Autonomous Community of the Canary Islands is responsible, on the one hand, for the general organization, at a regulatory level, of the Local Police forces of the Canary Islands, in its organic, functional and civil servant aspect, pursuing, therefore, an organization of all the nuclear aspects affecting the mentioned bodies.
On the other hand, it is responsible for regulating the means and systems that enable the joint action of the local police forces, within the scope of their respective powers, in order to achieve the integration of the respective particular actions in the citizen security system as a whole. that they have entrusted
Such tasks are not exhausted with the legal regulation, but rather, in order to guarantee a margin of regulatory flexibility, the law intends to focus on the main aspects of the regulation, referring its more detailed development to the regulation.
This new regulation is not only more ambitious in terms of its objective scope, but also aims to incorporate into the regional regulations the innovations introduced in state legislation with an impact on local police matters, such as community police, the exercise of judicial police functions, the possibility of municipal associations for the exercise of functions assigned to the local police or the changes introduced in civil servant legislation and on gender equality, in accordance with the provisions of Law 1/2010, of February 26, of Equality between Women and Men, and also accepting the provisions of Law 2/2021, of June 7, on Social Equality and Non-Discrimination for Reasons of Gender Identity, Gender Expression and Sexual Characteristics.
The new law is structured in 64 articles, distributed in four titles –General Provisions, Local Police, Official Regime of the Local Police and Autonomic Powers in terms of general planning and coordination–, complemented by eight additional provisions –Watchmen municipal authorities, Association of municipalities for the provision of local police services, Officials of the Canarian local police who are victims of gender violence, Information System of the Canarian Local Police, Equality plans, Access for military personnel of troops and sailors, Situations of Pregnancy, puerperium, lactation and maternity and Correspondence between categories and employment–, three transitory –Procedure for filling vacancies in process, Disciplinary files and Local Police Coordination Commission of the Canary Islands and the Local Police Participation Subcommittee –, one repeal and four finals.
The processing of this rule is provided for in the Legislative Program of the Government of the Canary Islands and work has been on it since the beginning of this legislature, although the extraordinary circumstances experienced in the area of Security and Emergencies -the covid pandemic- 19 and the volcanic eruption of La Palma, among others– have hindered its preparation and previous processing, which has been streamlined and accelerated once a certain normality was achieved.
PÉREZ: FEW POLICE OFFICERS IN THE CANARY ISLANDS AND NOT VERY WELL ORGANIZED
Pérez commented at a press conference that it is possible that the law will not be processed in Parliament given that “parliamentary times are getting shorter” and the Chamber will be dissolved at the beginning of April and the legislative “order portfolio” is very wide.
However, he has said that although Parliament “has a lot of work” that does not elude the Government of its obligation to continue processing legal initiatives apart from the fact that it is not a “lost job” because all the texts that are prepared will be useful for the future Government and future deputies.
He has pointed out that the Government’s “desire” is that city councils and unions can park their differences and that the law reaches the regional Chamber with the “greatest possible consensus”, assuming that the law leaves regulation “wide open” because each city council can attend to their “peculiarities” although homogeneity has always been demanded “because it is not reasonable that there are different working conditions” in the next municipality.
He has also said that there is a “misunderstanding” because “there are no major changes” in the law and although he personally is not in favor of the figure of interim personnel, he believes that it can be a solution for “exceptional cases”.
Pérez has admitted that the staff of almost 3,000 agents on the islands is “insufficient” and that they should also be “better organized” and has admitted that it is normal for there to be mobilizations as has happened with other public workers.
