SANTA CRUZ DE TENERIFE, Jan. 11 (EUROPA PRESS) –
The judge has ordered provisional detention, communicated and without bail for the alleged murderer of his ex-wife in Adeje (Tenerife) as the author of a crime of homicide and a crime of habitual mistreatment of the deceased, as well as a crime of serious injury to the child , according to sources from the Superior Court of Justice of the Canary Islands (TSJC).
This decision was adopted after giving a statement before the judge and after the night of Sunday, January 8, the 44-year-old man of Moroccan origin was arrested after allegedly killing his 46-year-old ex-partner.
The events occurred at his home, in the Armeñime neighborhood of Adeje, when the man stabbed his ex-partner to death in front of their four children, two of them from a previous relationship.
Even one of the woman’s children was slightly injured while trying to defend his mother from the attack.
Hayate, also of Moroccan origin, ended up dying on the street sidewalk after asking for help and the alleged murderer was held by a neighbor until the arrival of the Local Police, who arrested him.
The man had been released days ago after being arrested on December 28 for coercion towards his ex-ex-girlfriend, but the victim did not then file a complaint against him in court and he went from being classified in the Viogén System with a high rating to another medium of special relevance.
This medium level implies that direct contact with the victim is maintained, without other measures such as a restraining order.
RULED OUT REQUESTING CRIMINAL AND CIVIL ACTIONS
On the other hand, the murdered woman ruled out requesting criminal and civil actions, including a protection order, after having denounced him for threats on December 28. Sources of the TSJC detail that the victim appeared in the Court of Violence against Women Number 1 of Arona after denouncing the man before the Civil Guard and although he came to testify, he accepted his right not to testify against his partner.
The woman stated that the man investigated was her sentimental partner since 2013, that they were married and had two children and that in 2019 they had divorced. She, however, specified that they had resumed the relationship “as roommates” in March 2020.
The woman accepted her right not to give a statement “given the sentimental relationship” with the alleged murderer and despite offering him the request for a protection order, she stated that she was not interested in “taking any measure.”
Likewise, they point out from the TSJC, he was offered criminal and civil actions but he stated that he was resigning “as many as may correspond to him” and stated that the resignation was made “freely and voluntarily” without “any threat or coercion”.
Following this statement, the representative of the Public Prosecutor’s Office in the proceedings requested the provisional dismissal of the proceedings as there was no evidence that would disprove the presumption of innocence of the defendant, which was agreed by the judicial authority with the support of the complainant’s lawyer and the lawyer of the accused.
