The resolution of the General Directorate for the Fight against Climate Change of the Government of the Canary Islands by which the works related to the Cuna del Alma tourism project recognizes that the plant sad viper it is not threatened. Among his arguments, the general director, José Domingo Fernández, alludes to the Catalog of Protected Species, in which it appears in the category of special protection. This classification is reserved for wild species with some values, but “without being in any of the two threat situations (endangered and vulnerable), nor deserving of particular attention due to their ecological importance.”

This is the document that the Ministry of Ecological Transition, Fight against Climate Change and Territorial Planning sent to the company Segunda Casa Adeje, SL, ordering the total stoppage of the urbanization works carried out in El Puertito de Adeje. On the 10th, he also communicated it to the Adejero City Council, the Cabildo and the complainant who motivated this intervention by the Canarian Government: the Salvar la Tejita Association.

The general director of the Fight Against Climate Change and the Environment resolved to “initiate the environmental liability file for imminent threat of environmental damage to protected wild flora”, taking into account that the sad viper (Echium triste) has “special protection” under its “scientific, ecological, cultural value or due to its singularity or rarity”, according to the content of Law 4/2010, of June 4, of the Canary Islands Catalog of Protected Species. Cuna del Alma is a 350 million investment project by Belgian businessmen. It is developed in 136,000 square meters of 437,000, with 1,800 beds in 420 housing units. The forecast with its development is to create 750 jobs. The regional Executive has six months to resolve this file, which also obliges the promoter to “carry out a detailed cartography” so that the Autonomous Administration “the current and potential distribution” of the population of sad viper (Echium triste). The legal reports available to the Adeje City Council determine that “the imposition on the promoter of the obligation to carry out a detailed cartography of the entire affected area is an imposed duty without coverage. There is no rule that imposes that kind of duties and, even less, that you have to pay for it”, and cites article 14 of Law 26/2007 on Environmental Responsibility. A botanical report commissioned by the Cabildo limits the presence of the plant to 8,605 square meters, 2% of the 437,000 covered by the project. Taking these data into account, the promoter will request authorization to resume work on 96% of the land without any damage (the other 2% on hold is excluded due to the presence of archaeological remains, some affected).

It should be remembered that last Tuesday, the Canary Islands Agency for the Protection of the Natural Environment announced that it was initiating a disciplinary proceeding against the promoter Segunda Casa Adeje, SL, because the work lacked the mandatory environmental impact report. As it is a “serious” offense, it proposes a fine of 110,000 euros (the legislation scales between 24,000 and 240,400 euros). Amount that the company can reduce to 66,000 euros if it acknowledges its responsibility and makes the voluntary payment.

At the same time, Cuna del Alma remains awaiting another disciplinary file. The general director of Cultural Heritage of the regional government, Nona Perera, opened it on August 31, arguing that the works carried out affected engravings and destroyed archaeological remains. The proposed penalty is the maximum provided for very serious offences: 600,000 euros.

The echium triste is an endemic plant to the southwest of Tenerife and La Gomera, which means that it does not exist anywhere else in the world.
