The island director of Heritage of the Cabildo de Tenerife, Emilio Fariña, stated this Monday that from the corporation “the processes have been fulfilled” in a “diligent and lawful” manner after the complaint transmitted by the Tegüico Association about the construction of the tourist urbanization ‘Cuna del Alma’ in Puertito de Adeje and the competition is now in the hands of the Directorate General of Heritage of the Government of the Canary Islands.
From here, Fariña questions, “Is the General Directorate of Cultural Heritage going to do something besides mess with the Cabildo de Tenerife? Does it plan to maintain the paralysis, suspend it?”, stressing that they have required a response “in several times” to the Directorate of Cultural Heritage “and they do not specify anything”.
He recalled in a note that the Cabildo “precautionary paralyzed the works in the area indicated by the technical reports and after being informed of the archaeological study, it was decided to adopt the precautionary measure on the area in which the damage classified as very serious against heritage archaeological site, by the way, a precautionary measure that is still in force today”.
Once this step has been taken, he continues, “and after having shown an affectation categorized as very serious, this file has been submitted to the General Directorate of Cultural Heritage of the Government of the Canary Islands, which is the body that has the competence to instruct sanctioning procedures for this type of fault, as indicated in article 146.1 of the 2019 Law on Cultural Heritage of the Canary Islands”.
On the other hand, he has indicated that “if the Sí Podemos Canarias formation is sure that the works can be paralyzed, they must apply the legal mechanisms to do so”, since, according to the 2019 Law of Cultural Heritage of the Canary Islands, “it is that General Directorate which is empowered to suspend the work within the framework of the sanctioning file that is instructing “.
Along these lines, he commented that “if the regional office considers that it is the Cabildo that is not exercising its powers correctly, it can be subrogated to the powers of the insular institution to adopt precautionary measures as provided in article 15.3 of the same law” .
The insular director has also affirmed that “the representatives of Sí Podemos Canarias in the Government cannot play at being Government and opposition, they must assume responsibilities and not confuse the citizenry”.
