European arrest warrant for the mother of the Güímar girl

The European arrest warrant issued for the mother of the Guimar’s girl. The head of the Court of Instruction No. 3 of Güímar has issued a car in which you also agree to withdraw parental authority from the little APA to her mother to give her to her father, Joel Prieto.

The events date back to July 16, when, according to the testimony of her father, who is the one who denounced the disappearance of the girl –published through the ANAR Foundation after being picked up by the Ministry of the Interior–, the girl’s mother did not deliver the little girl to her father on the agreed date according to the custody agreement. According to the court order, that day Prieto went to pick up the girl but “a new incident in your delivery, being provided a video by the mother where the final phase of the same is verified, where the minor is crying behind the entrance door to the home and the father in these conditions does not access inside to pick her up against her will ».

It was the last time he saw the little girl. After the complaint, on July 28, it was broadcast a alert of disappearance of the girl through the ANAR Foundation.

Indications of the crime of child abduction

According to the judicial order, the investigated facts contain indications that could constitute a crime of child abduction foreseen and penalized by article 225.1 of the Criminal Code, with the aggravating circumstance of going abroad. Her mother purchased a return ticket on August 12 with the intention of delivering the minor to her father to enjoy her vacation period, which she herself communicated to the court, however said return flight to the Island has not been made. The woman thus responded to the Court, which had rejected the request made by the private prosecution (father of the minor) for the magistrate to adopt precautionary measures against the mother. Precautionary measures, which are now granted after the woman did not fulfill her commitment to return to the Island last Friday, August 12.

When the complaint about the disappearance of the girl was published by the ANAR Foundation, with judicial consent, the mother and now investigated sent an email to all the courts of the judicial district of Güímar and the media of the Archipelago, requesting that said publication be withdrawn, stating that no kidnapping had taken place and that she was enjoying her vacations with her daughter, since she claimed that she had previously scheduled them. In addition, as she herself assured, and is reflected in the court order, the father had refused to pick up the girl on those dates, so he took her with her to Barcelona to enjoy said vacations until August 16 , date on which the minor must be delivered to the father.
