Los Realejos asks residents to clean their land to prevent fires

The mayor of Los Realejos, Adolfo Gonzalez (PP)has dictated a new municipal band for the protection of public health and fire prevention urging owners of lots, parcels and other land located in the town to maintain them in minimum conditions of health, safety and public decorationas stated in the current applicable regulations, so they have the duty to carry out the respective cleaning, clearing or tidying tasks that are relevant.

The president of The Realejos warns on his side that “the accumulation of weeds, grass, fodder, as well as solid waste of all kinds generates potential fuel that can cause or facilitate the spread of fires, a situation that is aggravated by the lack of rainfall typical of these months, so, although we understand that the regulations are known, We have promoted this campaign for another year as a reminder”.

“We are not just talking about visual cleanliness, but environmental cleanliness, public health, fire preventionwith the importance that this entails to preserve the aforementioned properties and the adjoining ones, as well as the nearby natural environments, and the safety of the people”, highlights the realejero mayor.

According to this municipal sidecovered by current regulations, If the aforementioned tasks of cleaning and tidying up lots, parcels and land are not carried out voluntarily, the City Council could act in a subsidiary manner.always after hearing the property, and pass on the costs derived from these tasks, as well as the possibility of opening disciplinary proceedings.

The document also states that “the cleaning remains caused by the previous tasks must also be removed from the site and transferred to the relevant controlled landfill”. On the other hand, it is recalled that “it is strictly prohibited to throw garbage, solid waste or any type of waste in open spaces, whether publicly or privately owned”.

A legal obligation

Article 28 of Law 4/2017, of July 13, on Land and Protected Natural Areas of the Canary Islands indicates that “it is up to the owners to keep the installations, constructions and buildings in the mandatory conditions and, in any case, those of safety, universal accessibility and legally required ornamentation”. Add article 268.3 that “The owners of farmland located less than 500 meters from wooded forest areas must guarantee their cleaning and maintenance as a protection measure against forest fires.. In case of non-compliance, the corresponding city council is empowered to carry out the cleaning and subsequently pass on the costs to the owners, enabling financing formulas for those owners who, due to their socioeconomic situation, cannot assume such an obligation. Article 272.2 adds for the lots that “the execution orders may also order the cleaning and fencing of the Property”.

The Municipal Ordinance Regulating the Cleaning of Public Spaces and Urban Solid Waste Management (BOP nº20, of February 8, 2012) of Los Realejos provides that “the owners of land, farms and real estate located close to rural, neighborhood roads, must also condition the vegetation of said land so that, in no case, may extend beyond the limits of said farms or land, that is, extend over the public domain of the aforementioned rural roads.
