Civil Guard Seizes Over 1,000 Illegal Vapers from Shops in Southern Tenerife

The Civil Guard has confiscated 1,138 vaping devices intended for sale in various commercial outlets in Adeje and Arona, Tenerife, which did not adhere to existing regulations, with a total value exceeding 17,000 euros, as stated by the Armed Institute in a notice.

The probe commenced after specialised agents identified the illicit marketing and sale of these items in numerous establishments located in the southern region of Tenerife.

The Civil Guard has indicated that such actions pose a health risk to the public, as they disrupt the established sales channels set by health authorities for safe consumption.

In total, four inspections were conducted, during which agents were able to confirm that these outlets violated the prescribed regulations. Consequently, they reported the relevant breaches under Law 28/2005, dated December 26, concerning health measures against smoking, and regulating the sale, supply, consumption, and advertising of tobacco products, in accordance with Royal Decree 579/2019 from June, which governs certain aspects related to the manufacturing, presentation, and marketing of tobacco products and related items.

The majority of the confiscated vaping devices appear to have been sourced from outside the European Union by unauthorised importers.

In this context, the regulations stipulate that manufacturers and importers wishing to market nicotine delivery devices or refill liquids containing nicotine in Spain must register the product in the EU-CEG European portal, in addition to notifying the General Directorate of Public Health.

The investigation remains open, with the possibility of uncovering more establishments engaged in the illicit marketing and sale of these products.
