SANTA CRUZ DE TENERIFE Jan. 19 (EUROPA PRESS) –
The Provincial Prosecutor’s Office of Santa Cruz de Tenerife is seeking a ten-year prison term for an individual accused of sexually assaulting his girlfriend’s sister, who was a minor at the time.
The accusation, reported by Europa Press, reveals that the initial encounter occurred around the girl’s birthday when he claimed he had a “surprise” for her. He then entered her room, kissing her and touching her inappropriately despite her resistance.
He allegedly threatened her by saying “not to disclose anything or he would harm her,” persistently claiming that “no one would believe her anyway.”
The following day, while the family was making arrangements for the birthday celebration, the accused once more entered the minor’s room, pulled her from her bed, lowered her to the floor, and began to kiss and touch her against her will while he stripped her of her clothing.
He also coerced her into masturbation, sexually assaulted her, and remarked that it was time for her to lose her virginity.
With the support of her mother, the minor lodged a complaint. A biological expert examination of a stain found on the groin area of the trousers worn by the minor during the incident confirmed the presence of the accused’s semen.
The Prosecutor’s Office asserts that the minor’s account is “credible” and notes she does not exhibit signs of psychopathology or mental disorders that could affect her ability to act freely, understand, or fabricate lies without realising it. Furthermore, it indicates that as a consequence of the incident, she “feels frightened” about forming intimate relationships with men.
The prosecutor considers that the events amount to a crime of sexual assault against a minor under the age of 16 involving bodily invasion, and is also requesting a prohibition on approaching the minor within a distance of 500 metres or communicating with her, alongside a supervised release for ten years.
Additionally, they are seeking compensation for the victim amounting to 20,000 euros for psychological harm.
The trial is scheduled for next Wednesday at 9:30 a.m. in the Provincial Court.
