The Provincial Prosecutor’s Office of Santa Cruz de Tenerife has called for a ten-year prison sentence for a man accused of sexually assaulting his girlfriend’s sister, who was a minor at the time of the incidents.
According to the indictment obtained by Europa Press, the initial encounter was timed to coincide with the girl’s upcoming birthday, during which he informed her that he had a “surprise,” entered her room, and proceeded to kiss and inappropriately touch her against her will.
He also warned her not to disclose the incident, threatening to physically harm her, insisting that no one would actually believe her account.
On the following day, as the family was getting ready for the birthday celebrations, the accused returned to the minor’s room, lifted her from her bed, placed her on the floor, and began to kiss and touch her once again, despite her objections, while proceeding to remove her clothing.
He further compelled her to engage in masturbation, sexually assaulted her, and made statements indicating it was time for her to lose her virginity.
The minor, accompanied by her mother, subsequently filed a complaint, and a biological analysis of a stain found on the groin of her trousers from that day established the presence of the accused’s semen.
The Prosecutor’s Office emphasises that the minor’s narrative is “credible” and notes that she does not show signs of any mental disturbance or psychopathology that could impair her ability to act freely or understand the truth of her claims, or to lie without realising it. It additionally states that as a result of the incident, she now “feels afraid” of engaging in intimate relationships with men.
They maintain that the events constitute a crime of sexual assault against a minor under the age of 16, involving the use of bodily members, and also seek a restraining order barring the accused from approaching the victim within 500 metres or contacting her for ten years.
Furthermore, they are requesting €20,000 as compensation for the victim for psychological harm.
The hearing is scheduled to take place next Wednesday at 9:30 a.m. at the Provincial Court.
