The Contentious-Administrative Court number 1 in Santa Cruz de Tenerife delivered a judgement on December 20, 2024, in the ordinary procedure brought forth by ATAN through lodging a contentious-administrative appeal against the Resolution made by the Island Councilor of the Roads, Mobility, Innovation and Culture area belonging to the Cabildo de Tenerife, dated January 27, 2023. This resolution pertained to the final endorsement of the construction scheme entitled ‘Project of earthworks and installations for removable stands for the Tenerife International Motor Park’, located within the municipality of Granadilla de Abona.
As emphasised by the ATAN group, “the Court decided, in its judgement, to sustain the appeal submitted by this association, ruling it to be in violation of the Law and subsequently rendering the aforementioned Resolution void; thus, the cited project, which forms part of the four segments into which the Island Council opted to divide its International Motor Park initiative, has been annulled.”
Members of ATAN reminded that they had consistently argued that the Environmental Impact Declaration for this project, issued in 2011, had lapsed, as the works had not commenced more than twelve years after its approval, thus rendering the cause of expiration applicable under regulations governing environmental impact assessment. This was the basis for the court’s decision: the DIA has indeed expired.
Further statements from the environmental group conveyed that “this judgement is the initial one of the four expected relating to this contentious project; however, it is important to note that for the moment, the International Motor Park of the Cabildo de Tenerife will lack stands. Nonetheless, they underscore that the rationale provided in this ruling must be taken into account regarding other project approvals associated with this initiative that are still awaiting determination.”
The implementation of the motor circuit project is projected to entail an expenditure exceeding 13 million euros for the finances of the Cabildo de Tenerife, exclusively for the year 2025.
