The Canary Islands High Court of Justice (TSJC) has upheld the 9-year prison sentence for a man accused of sexually abusing a 13-year-old girl in Santa Cruz de Tenerife. The sentence, communicated by the TSJC’s press office, details the events of July 27, 2020, when the accused took advantage of the circumstance that the girl stayed overnight at his home with her mother. At that moment, the accused gave the girl two sedatives, under the influence of which he committed the abuse, causing several injuries to the victim.
After the facts were proven, the Sixth Section of the Provincial Court of Santa Cruz de Tenerife sentenced the accused to 9 years in prison. In addition, he was barred from exercising the passive suffrage right for the duration of the sentence. As an additional penalty, the court ordered him not to approach the girl within 500 meters and not to communicate with her by any means for 15 years. Likewise, a 6-year supervised release period was established after serving the sentence.

The convicted individual must compensate the victim with €10,000 for moral damages and €80 for each of the three days needed for her physical and psychological healing. Moreover, the expenses related to psychological and psychiatric treatment must also be covered by the accused.
The TSJC rejected the appeal filed by the accused’s defense, confirming in all its terms the sentence pronounced by the Provincial Court. The sentence also mentions that there is a possibility of filing a cassation appeal within five days, which must be submitted to the Second Section of the Supreme Court.
