Woman Admits to Misappropriating Brother’s Compensation for Disability


During a hearing at the Court of Santa Cruz de Tenerife, a woman confessed to being responsible for an aggravated misappropriation crime, admitting to retaining a portion of the half a million euro compensation that her brother received after being declared a person with reduced mobility following a traffic accident. Her brother was under her guardianship at the time.

The court’s ruling entails a two-year prison sentence for the woman, which she can avoid serving if she returns the misappropriated amount within five years.

An expert will now determine the exact amount during the sentence’s execution.

The Santa Cruz de Tenerife Prosecutor’s Office had accused the woman of taking advantage of a portion of the 565,000 euros compensation that her brother received from an insurance company due to a total disability claim.

Consequently, she assumed control of the assets without ever providing an account to the court on how she managed them. In reality, 362,000 euros were spread across various accounts and financial products.

The Prosecutor’s Office had sought a five-year prison sentence and also accused her of disloyal administration, alleging that she “squandered her brother’s money.”

Subsequently, the court withdrew her guardianship and appointed the legal representative of the Social and Health Care Institute (IASS) dependent on the Cabildo of Tenerife in her place.
