Tenerife-based Dental Technician Found Guilty of Professional Intrusion



A prosthetist with a laboratory in Taco has been sentenced by the Investigative Court No. 3 of San Cristóbal de La Laguna for professional intrusion. The sentence includes a four-month fine, with a daily fee of 6 euros, and payment of the procedural costs. The defendant agreed with the facts reported and the sentence requested by the Prosecutor’s Office during the oral trial, making the sentence final.

The College of Dentists of Santa Cruz de Tenerife, which had hired a private detective, reported the events to the Civil Guard. According to the judge’s resolution, the prosthetist examined a person’s prosthesis in his laboratory, removing its upper part in the presence of the hired detective. Subsequently, he proceeded to take measurements of the mouth and check the color of the pieces to make the prosthesis, tasks exclusively reserved for those holding the official title of dentist.

The crime of intrusion, as outlined in the ruling of the Criminal Court No. 9 of Santa Cruz de Tenerife, is stipulated in article 403.1, first paragraph of the Penal Code. The College of Dentists of Santa Cruz de Tenerife remains committed to monitoring and investigating cases of professional intrusion to protect the oral health of citizens and the interests of qualified dentists. Unauthorised actions pose a significant risk to the patient’s health.

The Collegiate Entity of the province of Tenerife reiterates the necessity to impose stricter penalties for trespassing, ensuring a deterrent effect and safeguarding the health of citizens.
