The appeal made by Santiago Pérez, former councilor of the La Laguna City Council, has been upheld by the Second Chamber of the Provincial Court of Santa Cruz de Tenerife, leading to the reopening of the ‘Reparos case’. This case is centered around the investigation of objections raised in the council to facilitate the extension of various municipal service contracts.
The order, initially reported by ‘Canarias Ahora’ and accessed by Europa Press, impacts the case of the former mayor, José Alberto Díaz (CC), the former councilors Atteneri Falero, Aymara Calero, Agustín Hernández (CC), Mónica Martín, and Javier Abreu (PSOE), as well as three municipal officials.
The Court, contrary to the Prosecutor’s Office’s request for dismissal of the appeal, has mandated the issuance of a new resolution which must “reasonably” decide whether to file the proceedings or proceed regarding the alleged crimes of prevarication and embezzlement of public funds attributed to the individuals under investigation.
The judge criticizes the provisional closure of the case by Court Number 4 of La Laguna, pointing out that it was solely based on the file of the separate piece related to the President of the Government of the Canary Islands, Fernando Clavijo, during his tenure as a senator.
Consequently, the judge highlights the lack of presentation of the Supreme Court’s arguments and justification of its connection with the raising of objections – reaching up to 48 between 2025 and 2017 – in the file.
Hence, the judge urges the court to make a “separate and reasoned” decision on the presence or absence of indications of criminal liability, emphasizing that the file provided by the Supreme Court is inadequate.
