The Provincial Court of Santa Cruz de Tenerife has imposed a two-year prison sentence on a man whom it considered the author of a crime against sexual indemnity for abuse of a minor under 16 years of age, after having entered the jacuzzi of a hotel in the island where the young woman was and carry out various touches.
The investigations were carried out after the girl’s family filed a report with the police which stated that around 7:00 p.m. on August 16, 2022, the man entered the swimming pool of the tourist complex. The teenager was there, whom the accused asked to sit next to him and then begin to touch her in different parts of her body, to which she reacted by pushing his hand away until she was able to let go and flee the place.
In principle, the Prosecutor’s Office requested three years in prison, the payment of 1,000 euros for moral damages and a sentence of removal of 500 meters from the young woman for five years, a period in which she would also remain on probation and would have to participate in a sexual education course.
Finally, the Court reduced the duration of the restraining order to two years, as well as that of probation, while the compensation was set at 500 euros.
The sentence was adopted by agreement in that the accused agreed with the facts, commission of the crime, participation and punishment, so it was declared final since none of the parties will appeal it.
During the hearing, it was also agreed to suspend the defendant’s entry into prison as long as he does not commit any crime during the two-year period.
