Fine of 30,000 euros for putting customers at risk in a nightclub in Tenerife

The Urban Planning Management in Santa Cruz de Tenerife proposes a fine of 30,000 euros for the party held last Christmas Eve in the Dubai roomat the Polígono El Mayorazgo, organized by Univerzzo. The event was evicted and suspended by the Local police and for the National Police, as El DÍA reported, after a avalanche of young peoplenumerous anxiety attacks and faintingwhen “the authorized capacity was greatly exceeded.” The sanctioning proceedings initiated by Urban planning establishes, precisely, that the safety of people was put “in danger” “because the capacity of the establishment had disproportionately increased”which is considered a very serious violation.

The Chicharrera Local Police counted a total of 665 young people inside the premises, “exceeding by 415%” the capacity that the Urban Planning Management of the Santa Cruz City Council had authorized, of 150 people, as indicated by municipal sources and as stated in the previous communication presented to celebrate the event. Added to these were the numerous attendees who were on the street, in a long line, waiting to access the room. The data provided by the Chicharrero Consistory indicate that 1,500 tickets were sold, multiplying the allowed capacity by 10. The party was held after a contract signed between its organizers, Univerzzo, and the owner of the Dubai venue, in which he guaranteed that the venue had a capacity for 950 people and all the necessary permits.

In the sanctioning file initiated by the Municipal Planning Management against the celebration of this party and against the premises in which it was also held the “definitive” cessation of the activity of the Duba room is proposedYo. The document, to which ELDÍA has had access, indicates that, in addition to the established capacity being “vastly” exceeded, the regulations regarding extinction of firesemergency exits and ventilation.

The file shows that the rule regarding fires and emergency exits has been breached.

It is established that the promoter of the party carried out an activity “without subjection to the measures contained in the authorized or communicated project, or to those imposed by the competent body, especially those related to access, emergency exits, fire extinguishing and any others that “tend to security in places intended for public performances.” In the file, Urban Planning insists that the celebration of this festival represented a “risk” for the safety of the establishment’s users.

This file is directed against the owner of the Dubai theater, who has a period of ten days to provide “whatever allegations, documents or information he deems relevant.” If you do not present anything, the fine proposal will be final. In the event that the promoter of the activity recognizes his responsibility and makes the voluntary payment “at any time prior to the resolution”, the procedure will be terminated and a 50% reduction will be applied to the fine.

Urban planning indicates that the capacity of the room was increased “disproportionately”

In the file of the Municipal Urban Planning Management The “deficiencies” detected by the Chicharrera Local Police during the inspection carried out at the premises are included., once it was evicted. Among these are the difficulty of access to fire extinguishers, “obstructed by furniture”; floor without non-slip material; fabric curtains with fire risk due to their high flammable prevalence; insufficient ventilation and air extraction; total absence of signage; and emergency exits and evacuation routes “totally blocked” by stacked wicker furniture, construction materials of different types and wood.

Likewise, and according to the Urban Planning document, the Police also includes among the deficiencies detected that the personnel with access control functions “did not have a customer counter to verify compliance with the capacity”, and that the audiovisual equipment, “contracted to a company”, did not meet the characteristics of an activity of this type (discotheque) and lacked an acoustic impact study.
