A man is sentenced for leaving the restaurant from which he was fired in Tenerife without paying



The Provincial Court of Santa Cruz de Tenerife has ratified the obligation for a man to pay about 700 euros, considering him responsible for a crime of fraud and minor injuries committed when he went to the oriental food restaurant located in the center of the capital from which he had been fired and then leave without paying.

The events took place in August 2022 when the former employee “with the clear intention of deceiving” ate at this establishment, spending 94 euros and then left the premises without paying the bill.

He was then chased by an employee who caught up with him in a shopping center, where they both struggled.

In the first instance, the defendant was imposed the same sentence as the one now ratified and it is now indicated that the sentence is final and remembers that if he does not pay the fine for each two daily installments not paid, he will be sentenced to one day of deprivation of liberty. .

But since these are minor crimes, they can be fulfilled through permanent location and each day of non-payment will imply another day of work for the community. As an accessory penalty, he is obliged to pay the legal costs and pay the amount he left unpaid at the restaurant.

Before the Court, the previous employee alleged an error in the assessment of the evidence, to which in the second instance he was responded to that in the hearing held at that time the facts were fully proven and were based on the fact that the defendant left the restaurant without paying the fee. account.

To approve this accusation, it was enough to provide the Court with the content of the cashier’s invoice issued that day and the statements of witnesses who saw the fight between the two in the shopping center.
