A man has accepted the sentence of two years in prison and pay 6,000 euros in compensation to a friend of his with whom he had non-consensual sexual relations while he was asleep and under the influence of alcohol.
The defendant assumed these penalties during the trial held today Monday at the Santa Cruz de Tenerife Court in which an agreement was reached between his defense and the Prosecutor’s Office.
The convicted person will avoid entering prison on the condition that he does not commit any crime during the next five years.
During this period he will remain on supervised release and must notify the court ten days in advance of any change of address.
He will also be required to stay half a kilometer away from the victim, his home and workplace, throughout that same time and will have to undergo a sexual education program.
In principle, the Public Ministry requested a sentence of eight years in prison and the payment of 2,000 euros to compensate for the moral damages caused to his then friend.
When the events occurred, both had known each other for a few months and therefore went out for a night out with other people, so they had several drinks in the center of La Laguna.
At an undetermined time, the complainant and the accused went to the former’s home in La Laguna, since the latter lived in Santa Cruz, and was invited by his friend to spend the night at his house.
When they arrived, they both lay down in the only double bed that was free and at one point the defendant began to caress the victim’s chest, to which he responded that he felt uncomfortable so he asked him to let him sleep.
From that moment on, he turned over and fell asleep deeply due to the drinks he had consumed that night, a circumstance that the accused took advantage of so that, against his friend’s will, he sexually assaulted him, without his being able to react.
It was not until he woke up hours later that he began to blurry remember what had happened, so he went to the hospital to be examined and check if his suspicions were true.
There they collected certain biological samples from him and he immediately filed the corresponding complaint at the La Laguna National Police Station.
