The judge, Carolina Déniz de Lion, agrees to dismiss the case following the request made by the defense of Carlos Alonso, the lawyer Javier Velasco Almendral, to which the prosecutor adhered, and which evidenced the atypicality of the facts under investigation, agreeing with the criteria of the Court of counts.
After an exhaustive examination of the documentation provided by the defense of Carlos Alonso and the testimony of several witnesses, The magistrate in charge of the investigation has ordered the file of the case. Referring to a previous document from the Prosecutor’s Office, it is recalled that abundant documentation has been provided that justifies the motivation for the purchase of Geneto’s land and that, according to witnesses, the acquisition by the Tenerife Science and Technology Park had the necessary financial reports.
In this sense, it should be noted that the Spanish Court of Accounts archived, at the beginning of this year, the procedure on the purchase of the Geneto lands carried out by the Tenerife Science and Technology Park after the Public Prosecutor’s Office endorsed that the same “It is duly justified, both by the form and by the price paid.”
The document from the Public Prosecutor’s Office also refers to the complaint made in October 2020 by the PSOE and Citizens –which then made up the government of the Cabildo of Tenerife–, which was based on a report issued by the auditor of the insular Corporation, Antonio Messía –already retired–, and who at that time was CEO of the Technological and Renewable Energy Institute (ITER), Elena Rodríguez, and points out that it has “an initial bias” by not providing all the documentation of the operation carried out by the Cabildo and the Tenerife Science and Technology Park.
Furthermore, the statements expressed by the witnesses agree that the purchase was motivated by the impulse of the relationship between the University of La Laguna and the Tenerife Science and Technology Park, and which had favorable reports from the Treasury and the Intervention of the Cabildo. Likewise, the Public Prosecutor’s Office comes to ratify the decision of the Spanish Court of Accounts, which considers the appraisal carried out at that time to be valid and that the purchase did not entail any loss of public funds.
The PSOE and Ciudadanos in the Cabildo of Tenerife had denounced, in October 2020, an alleged operation on Geneto’s land due to the possible commission of several crimes by the previous leaders of the island Administration, based on the report carried out by Antonio Messia and Elena Rodríguez.
From the first moment, those investigated – now exonerated by virtue of an order issued the day before yesterday – indicated that said reports were biased, that documentation was missing and that the operation had been carried out in accordance with the law and following all established legal procedures.
The procedure has its origin in the communication sent to the Court of Auditors on October 13, 2020 by the auditor of the Island Council of Tenerife, Antonio Messía, referring to “some facts that could constitute accounting liability.” Facts consisting of the purchase, by the public company Parque Científico y Tecnológico de Tenerife SA, through public deeds dating from January 24, 2012, of 30,700 square meters of land, distributed in two plots of the Ciudad Deportiva del CD Tenerife , in Geneto. That surface was acquired for 18,992,460.27 euros. They correspond to two plots of the CD Tenerife Sports City.
Ricardo Melchior and Carlos Alonso, the former island councilors Antonio García Marichal (CC) and María del Pino León (CC), the former island director of Innovation Juan Antonio Núñez and the Science Park lawyer José Luis Luengo, the only one who was not a Park councilor Scientific and Technological but advisor.
