The Provincial Traffic Headquarters of Santa Cruz de Tenerife lived an event, to say the least, surreal last September. A 29-year-old man was planning to take the point recovery exam – he had lost all of them – and he went to the establishment, nothing more and nothing less, than driving his own motorcycle..
One of the functions of Traffic Research and Analysis Group (GIAT) It consists of inspecting the theoretical knowledge tests to obtain the different driving licenses, as well as checking and verifying the identity of its assistants to avoid irregularities such as identity theft.
Precisely, it was during one of these inspections that this individual was detected, who even parked his vehicle outside the Headquarters.
He was then identified and informed that he would be investigated for an alleged crime against road safety for driving a motor vehicle or moped, with total loss of the points assigned to his driving license. Thus, he will have the obligation to appear before the judicial authority when required.
Finally, the corresponding police reportwhich was delivered to the Investigative Court acting as Guard of the judicial district of Santa Cruz de Tenerife.
In parallel, during said inspection, a person who was taking the theoretical exam to obtain a class B driving license was also identified due to the possible use of an intercom device.
At the end of the test, the necessary checks were carried out, verifying that this person used a communication system consisting of a earpiece and a micro-camera connected to a modem device hidden in clothing.
Once identifiedhe was informed that these events constitute a very serious infraction of the Road Safety Law, for which the Provincial Traffic Headquarters of Santa Cruz de Tenerife has sanctioned both the applicant and the collaborator for said infraction, in addition to not be able to take the test within a period of six months.
Applicable regulations
In accordance with the provisions of the current Penal Code, the crime of driving a motor vehicle or moped with loss of all the assigned points carries a prison sentence of three to six months or a fine of 12 to 24 months or work. for the benefit of the community from 31 to 90 days.
In relation to the use of intercom devices not authorized by regulation, it is noted that in the month of March 2022, with the entry into force of a modification of the Road Safety Law, which among others expands article 77, a new tool to General direction of traffic, incorporating as a very serious infraction the use of intercom devices not authorized by regulation, in the tests for obtaining and recovering driving permits or licenses or other administrative authorizations to drive, or collaborate or assist with the use of said devices. In this way, the offender can now be punished with a 500 euro fine and the impossibility of taking a new exam within a period of six months.
These behaviors pose a serious danger to road safety, as attempting to obtain a driving license fraudulently, lacking the necessary theoretical knowledge.
