Forces of the Traffic Group belonging to the Research and Analysis Group of the Canary Islands Traffic Sector (GIAT) have investigated a 29-year-old man who took the exam to recover points at the facilities of the Provincial Traffic Headquarters. from Santa Cruz de Tenerife driving his own motorcycle.
Among the functions inherent to the GIAT is the inspection of theoretical knowledge tests to obtain the different driving licenses, as well as the verification and verification of the identity of its assistants to avoid, among other irregularities, identity theft.
In one of the inspections carried out last September, they detected that one of the people designated to carry out said tests went to the facilities where the exam is carried out driving his own motorcycle, which he parked outside said Headquarters.
The agents proceeded to identify him and informed him that he was going to be investigated for an alleged crime against road safety for driving a motor vehicle or moped with loss of all the points legally assigned to the corresponding driving license, which entails the obligation to appear before the judicial authority when required.
The corresponding police report was prepared regarding the facts investigated, which has been delivered to the Investigating Court acting as Guard of the judicial district of Santa Cruz de Tenerife.
With earpiece in the theoretical exam
Likewise, and during said inspection and in collaboration with the Provincial Traffic Headquarters of Santa Cruz de Tenerife, a person was identified during the theoretical exam to obtain a class B driving license due to possible use of means of transport. communication during the test.
In the exam room of the Provincial Traffic Headquarters of Santa Cruz de Tenerife during the theoretical exam, an applicant raised suspicions of using an intercom device to take the test.
At the end of the examination, some checks were carried out and it was found that this person used a communication system consisting of a earpiece and a micro-camera connected to a modem device hidden in clothing.
Once identified, he was informed that these events constitute a very serious infraction of the Road Safety Law, for which the Provincial Traffic Headquarters of Santa Cruz de Tenerife has sanctioned both the applicant and the collaborator for said infraction. in addition to not being able to take the test within a period of six months.
Regulations applicable to each case
In accordance with the provisions of the current Penal Code, the crime of driving a motor vehicle or moped with loss of all the points legally assigned to the corresponding driving license, with a prison sentence of three to six months or with fine of twelve to twenty-four months or with work for the benefit of the community of thirty-one to ninety days.
In relation to the use of intercom devices not authorized by regulation, it is noted that in the month of March 2022, with the entry into force of a modification of the Road Safety Law, which among others expands article 77, a new tool to the General Directorate of Traffic, incorporating as a very serious infraction the use of intercom devices not authorized by regulation, in the tests for obtaining and recovering driving permits or licenses or other administrative authorizations to drive, or collaborate or assist with the use of said devices. In this way, the offender can now be punished with a 500 euro fine and the impossibility of taking a new exam within a period of six months.
These behaviors pose a serious danger to road safety, by attempting to obtain a driving license fraudulently, lacking the necessary theoretical knowledge.
