The Provincial Prosecutor’s Office of Santa Cruz de Tenerife requests a four-year prison sentence for a man for removing the condom, without the consent of his partner, during a sexual relationship at his home in the municipality of La Matanza.
The letter, collected by Europa Press, indicates that the woman agreed to have sexual relations with the “unavoidable condition” of the defendant’s use of a condom, something that he “reiterated to her on several occasions.”
However, after beginning sexual relations with penetration, and “being fully aware” that he was contravening the woman’s will and without her being aware of it – he was on his back – he removed the condom and ejaculated inside her.
The Prosecutor’s Office considers that the facts constitute a crime of sexual abuse and also requests disqualification from the right to passive suffrage for the duration of the sentence, supervised release for five years, the prohibition of approaching and communicating with the victim and participation in training programs. of sexual education.
It also requests payment of compensation of 3,000 euros for the victim.
The trial will be held next Monday, at 11:30 a.m., at the Provincial Court of Santa Cruz de Tenerife.
